Re: Termination of Tenancy Agreement at [your address], due to Domestic Violence

I am writing to give you notice that I must vacate the premises immediately because of the violence of the other tenant, [name], towards me. As you are aware I am a co-tenant with [name] in the above premises. I have attached a copy of the Apprehended Violence Order against [name].

I draw your attention to section 69a(1) of the Residential Tenancies Act 1987, which states:

“The Tribunal may, on application by a tenant under a residential tenancy agreement, make an order terminating the agreement if it is satisfied that the tenant would, in the special circumstances of the case, suffer undue hardship if the agreement were not terminated.”

I would be prepared to assign my tenancy over to [name].

If you are not agreeable to me ending the agreement, I will apply to the Consumer, Trader and Tenancy Tribunal for an order to this effect. I trust that this will not be necessary.
