I refer to your requests that I contribute to electricity costs at the above premises which are not separately metered. As the electricity account is held in your name, section 72(1) of the Electricity Supply Act 1995 applies and states:

“A person to whose premises electricity is supplied under a wholesale supply arrangement or customer supply contract must not charge any other person for the use of electricity so supplied.”

As my part of the premises is not separately metered, I am not required to pay electricity costs.

Your request that I pay part of the electricity costs is in contravention of the Electricity Supply Act 1995 and carries a maximum penalty of $22,000 for corporations or $5,500 in any other case.

I trust this letter clarifies the matter.
